MESSAGE FROM PRESIDENT THOMAS A. KENEFICK, III

In December, 2011, members of the Board of Directors were fortunate to spend a day with Elizabeth Derrico, who is an associate director of the American Bar Association’s Division for Bar Services. Several of us had the pleasure in the past dealing with her at Bar Leadership Institute conferences and other meetings and found her presentations to be energetic, innovative, and motivating. She brought those characteristics to Springfield and, to be sure, was not a disappointment.

At the meeting, she presented the results of an electronic survey taken of our members on the services and benefits offered by our Association. There was a high response rate by our membership. The survey results were most encouraging in that we as an association have been successful in fostering a positive reputation for our profession; providing our members with meaningful information on their areas of practice by keeping them current as well as developing a healthy relationship between the bench and the bar. The survey suggested that our members feel they are getting a good value for their dues dollar and that communications between the board and the membership are satisfactory. Moreover, the survey revealed that our educational programs are both relevant and helpful and that the membership supports the Board’s efforts in taking strong stands, when necessary, to bring the appropriate attention to the public of our Bar’s position on legal issues as they affect our community.

Importantly, the survey also identified member concerns such as (1) keeping up with changes in the law; and (2) client development in the current economic climate. Obviously, these are two areas which we will continue our efforts to improve.

In short, the survey provided a framework for our discussions during our meeting. One significant issue is the virtual certainty of mandatory continuing legal education. We believe it is important that we should be on the forefront of this project in terms of the scope of the curriculum, costs, and by whom it should be undertaken. It certainly appears that this may result in the emergence of a cottage industry vying for the mandatory CLE dollar. Without question, we believe we can, perhaps in conjunction with MCLE and the MBA, play a significant role in the development, preparation, and delivery of these programs at a reasonable cost to our membership, particularly to those that are new to the practice.

Another concern is the need for our bar association to reach beyond Springfield to the communities of Westfield, Holyoke, Palmer, in terms of conducting bar related activities there. Moreover, the area of community outreach, about which I wrote in an earlier message, continues to be a theater which is fertile for development. Plainly, this is a forum where volunteers can really make a difference.

Clearly, the meeting was most productive and was well received by each member of the board. I think all of us came away from that session energized and inspired to do a better job for our association. To that end, we look forward to a productive 2012 in terms of the development of new programs, continuation of our excellent educational presentations, invigorated bench bar committees and the delivery of quality services to our members.

I would be remiss if I did not mention the welcome additions of retired justices Nancy Dusek-Gomez and Jacques C. Leroy to our Arbitration/Mediation Panel.  As I am sure you would agree our panel continues to be more enhanced with these additions and clearly more valuable to our members.

On a lighter note, we had a holiday reception at the Hoffbrahaus on December 21, 2011. The event was well attended and, from the feedback I received, everyone enjoyed the fellowship of the season.

The New Lawyer's Section annual holiday party was held on Friday, December 17, 2011 at Attorney Jeffrey S. Morneau's house.  Many thanks to Jeff and Kate for hosting the holiday party. It was a wonderful evening with great food, drink and socializing.

Annual Toy Drive-Follow Up

The New Lawyers Section 4th annual toy drive was a huge success!  In addition to cash and Toys R Us gift cards an abundance of toys were donated to the Toys for Tots foundation.  Thank you to all who donated to make this holiday special for others.

PROBATE & FAMILY COURT

MUPC Delay

The implementation for the new Massachusetts Uniform Probate Code will be delayed for ninety days until March 31, 2012.  The Transitional Standing Order (5-11) has been amended to extend the time frames acccordingly.  New MUPC Petitions and MUPC forms cannot be accepted for filing until after March 31, 2012. The Press Release announcing the delayed implementation of MUPC; Amended Standing Order 5-11; Revised Supplemental Notice Form (MPC 591) with updated instructions (MPA) 938 can be accessed through the Court website or by clicking here.

Changes to Probate Court Rules

Effective January 2, 2012, the Massachusetts Rules of Civil Procedure and the General Rules of Probate Court have changed.  The revised rules can be found on the Probate & Family Court website or by clicking here.

The Arbitration and Mediation Service is proud to announce two (2) new additions to our panel: retired Justices Nancy Dusek-Gomez and Jacques C. Leroy.  Both are an impressive addition to our roster.

The Hampden County Bar Association Arbitration and Mediation Service maintains a roster of highly qualified lawyers and retired judges for arbitration, mediation, or case evaluations. HCBA FORECLOSURE TASK FORCE

Foreclosure Task Force

The HCBA Foreclosure Task Force would like to ask any attorney who is unable to accept a client and/or individual homeowner facing the prospect of foreclosure to refer that individual to the Hotline (322-7404) that is maintained by the Hampden County Bar Association Foreclosure Task Force and the Alliance of Providers of Legal Services to Individuals Facing Foreclosure and staffed by the Massachusetts Justice Project and the Hampden County Legal Clinic. The Hotline will arrange for the individual to meet with a volunteer attorney and seek to provide legal representation.

The Task Force welcomes additional volunteer attorneys willing to participate in the ongoing efforts to provide legal representation to those individuals facing foreclosure. Interested volunteers should contact Hampden County Legal Clinic at  413-733-6500 or hampdencountylegalclinic@verizon.net.

LAWYER REFERRAL & INFORMATION SERVICE

The Hampden County Bar Association's Lawyer Referral & Information Service (LRIS) meets American Bar Association standards for lawyer referral and has a Reduced Rate Panel. Anyone interested in participating in the lawyer referral program can contact our office at 413-732-4648 or via email at lawyerreferral@hcbar.org. Within the last thirty days, attorneys have submitted over $3,640.00 in LRIS referral percentage payments a result of over $24,350.00 in client fees.

CHILDREN'S LAW PROJECT

Children's Law Project Training

The Children's Law Project will be holding a training on Appeals in CLP Cases & a CLP Roundtable with Probate Court Judges on Thursday, January 12, 2012 from 2:00 - 6:00 p.m. at the Hall of Justice, Commissioner's Room, 2nd Floor.  Attorney Tahirah Amatul-Wadud will be moderator with guest speakers, Attorney Michael Cutler from CPCS and Attorney Mary Samberg.  A roundtable discussion will be held with the Hampden County Probate & Family Court judges.  If you would like to submit questions or a topic of interest for the discussion please submit to admin@hcbar.org.  There is no fee to attend but pre-registration is required by contacting Noreen Nardi at the HCBA at 732-4648 or admin@hcbar.org. CLP Grant

The Hampden County Bar Association received an IOLTA Grant from the Massachusetts Bar Foundation in the amount of $70,000 for funding of the Hampden County Bar Association's Children's Law Project for the 2011-2012 Grant year. We are very grateful to the Massachusetts Bar Foundation for their continued support of this program.

Through this program, children receive legal representation in the Hampden County Family and Probate Court for an array of matters. The program is looking for qualified attorneys to represent these children. Attorneys are paid at a rate of $50.00 per hour with a maximum amount of $1,500.00 paid per case. With recognition that more cases are being settled and not going to trial, we have revamped our application. COURT HOUSE NEWS

 Registry of Deeds

As of January 1, 2012, the Hampden County Registry of Deeds will no longer charge a $.50 per page fee for copies to their online users that print documents from their homes or offices.  The $100.00 annual fee for an online account was also eliminated in July, 2011.  The $1.00 per page fee will remain in effect for certified copies of documents purchased within the registry office.

U.S. District Court Notice of Vacancy

The United States District Court U.S. Magistrate Judge is currently accepting applications for term law clerk for an approximately 12 month position starting August 20, 2012 in Springfield, MA. For information on how to apply, click here.   Deadline for applications is February 17, 2012.
