MESSAGE FROM PRESIDENT THOMAS A. KENEFICK, III
Overall, January proved to be a “red letter” month. Christina Turgeon’s hard work, at the direction of the Board of Directors, obtained for us a $15,000 grant from Mass Mutual to fund our legal clinic. This is obviously welcome news for our association and its endeavors to serve members of the public. Mass Mutual, too, through Dorothy Varon’s leadership in its law department, has expressed an active interest in becoming more involved with our activities and outreach. In addition to the grant money, Mass Mutual has generously offered to provide additional resources via its in-house legal personnel to augment those that are volunteered to our legal clinic and other related programs. Mass Mutual is enthusiastic about becoming a partner in more bar-related association activities. The benefits from Mass Mutual’s participation symbolizes the beginning of a relationship that can only be of benefit, not only to both Mass Mutual and the HCBA, but to the community we serve. My sincerest thanks to Dorothy and Christina for their wonderful work.
In other news, on Saturday, January 21, 2012, the New Lawyer section sponsored a lunch for the homeless in the South Congregational Church. A number of our members were present to help prepare and serve the lunches to the homeless, as well as to assist with clean-up. Those members should be commended for their excellent contribution to this worthy effort.
For those who were interested in the implications of the recent Ibanez litigation, a lunch seminar was conducted by the Real Estate section at which members of REBA spoke. The event was well-attended and members found it enlightening. Also the Real Estate section announced that they recently made a generous monetary donation of $500.00 to the Emergency Food Pantry of Springfield.
Plans are in the making for Judge’s Night, which will be held sometime in March or April.

As you can see, during the winter months, we continue to be more than active in making our presence known and providing services to our membership and our community. Our bench bar and brown bag functions continue to draw good numbers and provide education and assistance to our membership.
Hopefully, the ground hog’s appearance on February 2nd will be a harbinger of an early spring. I look forward to seeing all of you soon.

On January 10, 2012, the HCBA was presented with a Proclamation from the City of Springfield and Mayor Domenic J. Sarno proclaiming January 10, 2012 as Hampden County Bar Association Day. The Proclamation was given during a Recognition Lunch for volunteers who assisted in tornado relief efforts and for attorneys who volunteer in the Hampden County Housing Court project and 100 Lawyer Challenge. PROBATE & FAMILY COURT
Notes from January 19, 2012 Bench Bar
1. As people are likely aware, the MUPC has been delayed. When the MUPC is implemented, there will be a practitioner available at Court as an MUPC Advisor. Additionally, there will be a phone in program where an attorney is available from approximately 2:00 – 4:00 p.m. one (1) day per week for phone calls from attorneys.
2. The Probate and Family Court is attempting to implement a protocol for telephonic appearances. Anyone who needs a copy of the telephone appearance protocol should e-mail Claudine T. Wyner at: ctwyner@marienhodge.com .
3. Another reminder to the Bar that protocol for Administrative Allowance requires three (3) business days notice for any motions to be handled administratively and should include fax numbers for prompt response.
4. As of January 17, 2012, there are new 209A forms in effect. The Probate and Family court’s website has the updated forms. It is important for practitioners to note, that if there are additional orders not included in the standard paragraphs that those Orders need to be attached to the Restraining Order. On the website there is also a revised guide to the new form.
5. A note to the Bar, that if you have an uncontested motion scheduled and you do not wait to present your motion, your motion will be denied. You must remain in the courtroom until your motion is heard.
6. Finally, the new Alimony statute is effective March 1, 2012.

Civil Case Management Conferences
The District Court Civil Case Management Conferences will be changing the time it conducts its sessions to Tuesday afternoons at 1:30, 2:30 and 3:30 p.m. beginning March 6, 2012.
Notes from January 9, 2012 Bench Bar
On January 9, 2012, three representatives from the Hampden County Sheriff’s Department, Jim Kelliher, the Director of the Howard Street facility, Tom Connor, the Assistant Deputy Superintendent of Classifications, and Marty Lyman, the Research Specialist Director, spoke on issues of inmate classification, pre-trial release and post-conviction early release. The presentation and follow-up discussion was very informative, inmates are classified, according to an eligibility assessment, based upon the type of crime, the criminal history, pending legal matters, the length of the sentence, and how the inmate adjusts to the institutional setting. Non-dangerous crimes include certain drug and property-related crimes, motor vehicle crimes resulting in no injuries, and crimes involving no injuries to victims or threatening harm to others. Dangerous crimes include violent and sex-related crimes, weapons-related crimes, motor vehicle crimes with injury, property crimes that convey threats, and escapes. The goal is to move inmates to a reduced security-type setting over time which, in time, hopefully reduces recidivism.
The Sheriff’s Department’s plan is to encourage re-entry of inmates, focusing on issues of safety, security and supervision, and hopefully will result in self-discipline of inmates. Approximately 85 to 90% of inmates are held at the House of Correction, either for drug and alcohol related offenses, with 73% of the population being unemployed, and 55% minorities. The House of Correction’s model focuses on addressing confrontation and responsibility rather than incapacitation.
When considering attempted pleas, take into consideration any pre-trial detainment, as part of a time served and any good time credit that has accumulated during the incarceration period.

The District Court Bench Bar meetings are open to all attorneys who practice in District Court and court personnel as well. HCBA FORECLOSURE TASK FORCE
Foreclosure Task Force
The HCBA Foreclosure Task Force would like to ask any attorney who is unable to accept a client and/or individual homeowner facing the prospect of foreclosure to refer that individual to the Hotline (322-7404) that is maintained by the Hampden County Bar Association Foreclosure Task Force and the Alliance of Providers of Legal Services to Individuals Facing Foreclosure and staffed by the Massachusetts Justice Project and the Hampden County Legal Clinic. The Hotline will arrange for the individual to meet with a volunteer attorney and seek to provide legal representation. Office Location
In an effort to minimize expenses, the Hampden County Legal Clinic office is now located within the HCBA office, 50 State Street, Room 137. The legal clinic telephone number remains the same at 413-733-6500.
Lawyer for the Day
The Lawyer for the Day program continues to be a success due to the many volunteers who have offered their services in Western Division Housing Court on Thursdays. This is a great pro bono opportunity for area attorneys. This program benefits landlords and tenants who are income eligible. CHILDREN'S LAW PROJECT
CLP Grant
The Hampden County Bar Association received an IOLTA Grant from the Massachusetts Bar Foundation in the amount of $70,000 for funding of the Hampden County Bar Association's Children's Law Project for the 2011-2012 Grant year. We are very grateful to the Massachusetts Bar Foundation for their continued support of this program.
Through this program, children receive legal representation in the Hampden County Family and Probate Court for an array of matters. The program is looking for qualified attorneys to represent these children. Attorneys are paid at a rate of $50.00 per hour with a maximum amount of $1,500.00 paid per case. With recognition that more cases are being settled and not going to trial, we have revamped our application. Induction Ceremony
Members of the Hampden County Bar Association and the local legal community are invited to attend a Superior Court Induction Ceremony for John S. Ferrara on Monday, February 13, 2012 at 4pm. The ceremony will be held at the Hampden County Hall of Justice, 50 State Street, 3rd floor, Courtroom #2, Springfield. Refreshments will be served immediately following.
News from Eastern Hampshire District Court - Judge John M. Payne, Jr.
In trying to make the administrative session at the EHDC move smoothly, I would ask counsel to be in the courtroom when the daily session begins. This allows for a calculation of the schedule and to move those cases that are ready for disposition or are in need of a new date. Hopefully, this will allow the daily proceedings to move in a timely and efficient manner, which will in turn be of benefit to the Bar.
Also, I would urge all defense counsel to become familiar with the travel restrictions that are now part of the Probation Departments conditions. They are very specific and some might say draconian. For a number of defendants they will be problematic, as they and counsel attempt to resolve their case.

Massachusetts Bar Association Community Service Award Nomination
One of the most important local awards for public service is the Massachusetts Bar Association’s Community Service Award in recognition of “caring, involved individuals, eager to use their skills for the betterment of the community.” The award is presented to an attorney who is in good standing with the Massachusetts Bar Association and is a current member of the Hampden County Bar Association who “has performed an act or acts of outstanding public service within the community.” The recipient is nominated by the HCBA Board of Directors and approved by the MBA. Nominations should be submitted to the Hampden County Bar Association by contacting Noreen E. Nardi, Executive Director, at 732-4648 or via email at admin@hcbar.org by April 2, 2012.
St. Thomas More Society Panel Discussion
The St. Thomas More Society will be hosting a social & panel discussion, "Everything You Always Wanted to Know About Being Catholic But Were Afraid to Ask" on Wednesday, February 29, 2012 from 5:00 - 7:00 p.m. at the Fort, Springfield, MA. Western New England University Law and Business Center for the Advancing Entrepreneurship invite you to an upcoming event, "123's of Financial Literacy for Small Businesses - Managing Credit and Banking Relationship on Friday, February 3, 2012 from 1:00 - 4:00 pm at the Blake Law Center Room D. The 123's of Financial Literacy for Small Businesses is a complete curriculum of classes designed to help business owners with little or no business background get up to speed with useful business concepts. The classes are accessible, practical, and interactive. The program provides coverage of a wide range of important business ideas. Participants may want to attend all of the sessions to get a broad overview of business issues. However, each session will stand on its own, so an attendee may pick and choose the classes most relevant to his or her own business situation. Delivered by experts drawn from the business community and the Western New England University faculty, this program promises to deliver a lot of "bang for your buck." Cost: $20 per session. Divorce Mediation Training
The Mediation & Training Collaborative (TMTC), in collaboration with the Holyoke Community College Center for Business & Workforce Development, is offering its 34-hour, five-session training May 3 (3-8 pm) and May 4, 5, l8 & 19 (all 9 am to 5:30 pm). This training addresses the emotional and legal aspects of divorce, including division of assets and debts, parenting issues, working with gay and lesbian couples, and mediator ethics. Pre-requisite: 30 hours Basic Mediation Training. Cost is $825 ($775 with registration postmarked by April l) fee includes coached practice sessions, manual, 8 CAFL CLEs, parking and refreshments.

We the People: The Citizen and the Constitution
On Saturday, January 28th Easthampton High School students won the statewide competition We the People: The Citizen and the Constitution. The competition takes the form of a simulated congressional hearing where students testify as constitutional experts before a panel of judges. As winners of the competition, the students will represent Massachusetts at the 25th Anniversary We the People National Finals, held April 27- May 1, 2012 in Washington D.C. This is a great opportunity for a Western Massachusetts school and they are reaching out to the legal community to help defray the cost of traveling to Washington.
In order for the team of 10 students to compete at this prestigious event, $1,200 per student must be raised.
